Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you") and revelbit d.o.o., Jesenje 23D, 1281 Kresnice, Slovenia

("Company", "we", "us"), governing your use of the Pointeron platform ("Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Definitions

  • "Service" — The Pointeron location tracking platform, including the web dashboard, API, and all related services.
  • "Organization" — A workspace within Pointeron that owns assets, devices, and data.
  • "User" — Any individual who accesses the Service, including Organization owners and team members.
  • "Location Data" — GPS coordinates, speed, heading, altitude, and associated metadata collected from tracked devices.
  • "Device" — Any hardware or software tracker connected to the Service (AirTags, GPS trackers, smartphones, etc.).

2. Account Registration

  • You must be at least 18 years old to create an account.
  • You must provide accurate and complete information during registration.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorized use of your account.
  • One person or entity may maintain multiple Organizations.

3. Subscription and Payment

3.1 Plans and Pricing

The Service is offered under four subscription plans (Free, Basic, Pro, Enterprise) with per-device pricing. Current pricing is listed at pointeron.com/pricing. We reserve the right to change pricing with 30 days' advance notice.

3.2 Billing

  • Subscriptions are billed monthly or annually in advance via Stripe.
  • Per-device fees are calculated based on active devices during the billing period.
  • All prices are listed in EUR and exclude applicable VAT, which will be added where required by law.
  • Failed payments will be retried automatically. After repeated failures, the account may be suspended.

3.3 Refunds

Subscription fees are non-refundable except where required by applicable EU consumer protection law (Directive 2011/83/EU). If you are a consumer in the EU, you have the right to withdraw from the contract within 14 days of purchase, provided you have not begun using the Service.

3.4 Cancellation

You may cancel your subscription at any time from the Billing settings. Access continues until the end of the current billing period. No partial refunds are issued for unused time within a billing cycle.

4. Acceptable Use

You agree not to use the Service to:

  • Track any person without their knowledge and explicit consent
  • Violate any applicable law, regulation, or third-party rights
  • Engage in unauthorized surveillance or stalking
  • Transmit malware, viruses, or harmful code
  • Attempt to gain unauthorized access to the Service or other users' data
  • Circumvent rate limits, security measures, or access controls
  • Use the Service for any illegal purpose, including violations of GDPR or other data protection laws
  • Resell or redistribute the Service without written authorization

Consent for tracking persons: If you use the Service to track individuals (employees, family members, etc.), you are solely responsible for obtaining and maintaining valid legal consent from each tracked person in accordance with applicable laws, including GDPR Article 6 and any applicable employment law. Pointeron provides a built-in consent management system that sends consent requests to tracked individuals and allows them to accept, decline, pause, or withdraw consent at any time via a dedicated consent page. Tracked individuals can also submit data access and deletion requests directly from their consent page, which you are required to respond to within 30 days.

5. Data Ownership and Processing

5.1 Your Data

You retain all ownership rights to the data you upload to or generate through the Service, including Location Data and asset configurations. We do not claim ownership of your data.

5.2 Data Processing

We process your data solely to provide the Service as described in these Terms and our Privacy Policy. Where you act as a data controller under GDPR and we act as a data processor, the terms of our Data Processing Agreement (available upon request) apply.

5.3 Administrative Access to Your Data

Our support team does not have standing access to your organization's data. When access is needed for support or troubleshooting purposes, the following process applies:

  • An administrator submits a Data Access Request specifying the reason, data scope, and duration
  • The organization owner must explicitly approve the request before any data is accessible
  • Access is limited to the approved scope and duration, and can be revoked at any time
  • All access is recorded in an immutable audit log visible to the organization owner

5.4 Data Export

You may export your data at any time from the Support page in the dashboard (Data Export tab), or programmatically via the API. Upon account deletion, you will have 30 days to retrieve your data before it is permanently erased.

5.5 Data Deletion

When you delete your account or Organization, we will delete all associated data within 30 days, except where retention is required by law (e.g., billing records retained for 10 years under Slovenian tax law).

6. Service Availability

  • We target 99.9% uptime for the Service but do not guarantee uninterrupted availability.
  • Scheduled maintenance will be announced at least 24 hours in advance when possible.
  • We are not liable for downtime caused by factors beyond our reasonable control (force majeure), including internet outages, third-party service failures, or natural disasters.

7. API Usage

  • API access is subject to rate limits based on your subscription plan.
  • API keys are confidential and must not be shared publicly or embedded in client-side code.
  • We reserve the right to throttle or suspend API access in cases of abuse or excessive load.
  • The API is provided "as is" — we may deprecate endpoints with reasonable notice.

8. Intellectual Property

The Service, including its design, code, documentation, trademarks, and branding, is the intellectual property of revelbit d.o.o. and is protected by EU and international intellectual property laws. These Terms do not grant you any rights to use our trademarks, logos, or branding without written permission.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
  • We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or business opportunities.
  • Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amounts paid by you in the 12 months preceding the claim.
  • Nothing in these Terms excludes or limits liability for fraud, gross negligence, death or personal injury caused by our negligence, or any liability that cannot be excluded under applicable law.

10. Indemnification

You agree to indemnify and hold harmless revelbit d.o.o., its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the Service in violation of these Terms
  • Your violation of any applicable law or third-party rights
  • Tracking persons without valid consent
  • Data you upload, transmit, or process through the Service

11. Termination

  • You may terminate your account at any time by deleting your Organization from the Settings page.
  • We may suspend or terminate your account if you violate these Terms, with notice where practicable.
  • Upon termination, your right to use the Service ceases immediately. Data deletion follows the process described in Section 5.4.

12. Changes to These Terms

We may modify these Terms from time to time. We will notify you of material changes at least 30 days before they take effect, via email or a prominent notice in the dashboard. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Slovenia and applicable EU regulations. Any disputes arising from these Terms shall be resolved by the competent court in Ljubljana, Slovenia.

If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and revelbit d.o.o. regarding the Service and supersede all prior agreements and understandings.
